As she followed the marked walkway, her high heel caught in a hole in the asphalt, causing her to trip and fall forward. The hole had been left behind after the removal of a metal signpost, creating a hidden tripping hazard that was not properly repaired or marked.
As a result of the fall, our client struck her left knee and experienced immediate pain. Paramedics responded to the scene and transported her by ambulance to a local hospital. There, she was diagnosed with knee swelling and joint effusion, placed in a knee immobilizer, prescribed crutches, and given pain medication.
In the weeks following the accident, she required ongoing medical treatment for persistent pain in her neck, back, shoulders, and knee, as well as headaches and sleep disruption. Over the course of multiple treatment sessions, medical providers documented sprains, muscle spasms, and contusions that were directly related to the fall and unsafe condition in the parking structure.
The casino attempted to minimize responsibility for the incident.
